A lawyer for one of the men charged with the shooting murder of Chloe Jade Mason days before Christmas has alleged she was armed with a rifle when she turned up at his client’s home. 

Codye Ian Thomson, 29, of Marsden and Kaine Raymond Thomson-Gleeson, 32, of Caboolture, on Tuesday had their one charge each of murder mentioned for the first time in Brisbane Magistrates Court.

The pair were arrested without incident in Logan, south of Brisbane on Monday and remanded in custody.

Warrants were issued for the brothers’ arrest after Ms Mason, 23, died after she was allegedly chased down and shot on Railway Pde in Caboolture on December 22. 

Police said media and members of the public had assisted in locating the men.

Ken Mackenzie, solicitor for Thomson-Gleeson, outside court on Tuesday claimed his client had acted in response to an armed threat from Ms Mason.

‘What is not in dispute in this case is that Chloe Mason came to the front of Kaine’s house armed with a rifle,’ Mr Mackenzie said.

‘Kaine explained to police he did not kill Chloe. What he did, he did to defend his home and his family against a murderous attempt.’

Police do not believe the incident was a random attack, with the parties involved known to each other. 

Mr Mackenzie disputed the police’s statement about his client’s arrest and claimed Thomson-Gleeson was metres from a police station and about to hand himself in.

Neither Thomson, whose job was listed in court documents as a meat worker, nor Thomson-Gleeson, a plasterer, were required to appear in court in person or via videolink on Tuesday.

Thomson’s solicitor Brendan Beavon asked for the matter to be heard next on January 13 at Caboolture Magistrates Court so that a full brief of evidence could be ordered.

Police prosecutor Jordan Theed said the time frame  ‘might be a bit tight’ but he did not oppose the application as it would just lead to police being ordered to disclose their evidence at a later date.

Magistrate Lewis Shillito granted Thomson’s application.

Mr Mackenzie asked for the same application to be granted for Thomson-Gleeson when his client’s charge was mentioned.

‘Your Honour has no power to consider an application for bail,’ Mr Mackenzie said.

Mr Shillito also ordered Thomson-Gleeson’s case to be heard on January 13 at Caboolture Magistrates Court for a committal mention.

Police had been searching northern NSW for the pair since the incident on December 22.

Authorities allege Ms Mason knew the two men and had attended a Caboolture address where an altercation occurred and she suffered a fatal gunshot wound.

The brothers remained in custody as defendants charged with murder in Queensland can only apply for bail in the Supreme Court.

Daily Mail Australia previously revealed that Ms Mason was involved in a stabbing that almost claimed her life years before she was shot.

‘I’m in the [hospital] ward now,’ she shared on social media in 2016.

‘Still have 24/7 nurses hanging around me, checking up [and] making sure everything is correct and that nothing is out of place.

‘I have two drains in my heart to drain all the blood that’s leaking from the valve that’s been sliced when the knife penetrated my heart 3 cm deep.

‘I am fighting through this with the love and support from my family and friends.’

The shocking revelation comes after it was revealed her former on-again, off-again boyfriend Kane Alexanderson, 18, was himself stabbed to death in 2020 during a knife fight.

Hours after her death, Ms Mason’s devastated sister launched a fundraiser to share a heartbreaking message.

‘Chloe was only 23 years old,’ Hannah McKone posted on GoFundMe.

‘Being so close to Christmas her family has no savings or financial means to give her a funeral.

‘We are graciously asking for help and support in this. All funds donated will be directly utilised for Chloe’s funeral service.’

Another sister, Danni Mason, remembered Chloe as a ‘daughter, a sister, an aunt and a friend … who was loved by many’.

‘This loss has devastated our family and we struggle to come to terms with this so close to the holidays,’ she wrote.

‘As sisters we grieve for the things she won’t experience, all the things we aren’t able to share and the memories we won’t make. She was an incredible woman.’
