The anonymous Jane Doe who sued Diplo last June for allegedly distributing X-rated footage of their sexual encounters to third parties without her consent, filed a notice of dismissal on Monday.
The 29-year-old plaintiff decided to drop her revenge porn lawsuit against the 46-year-old DJ-producer (born Thomas Wesley Pentz) two weeks after Judge Mónica RamÃrez Almadani denied her request to remain anonymous.
‘The court appreciates that plaintiff’s allegations in her complaint are sensitive and of a highly personal nature and that she may face some public scrutiny,’ Almadani wrote in legal docs obtained by People.
‘However, absent a demonstrated need for anonymity, there is a prevailing public interest in open judicial proceedings.’
Jane Doe’s attorneys called the decision a ‘startling, imbalance of power’ telling Billboard: ‘In the digital age, being compelled to disclose one’s name in such proceedings risks permanently linking a survivor to their trauma.’
The plaintiff claimed to have dated Diplo between 2016 and 2023 and admitted she did give him permission to record them having sex at times, she ‘never gave him permission to distribute those images and videos to third parties.’

Jane Doe alleged she discovered the leak in 2023 when a third party informed her they received ‘intimate material’ including images of her ‘genitals, buttocks, and face’ back in 2018.
The plaintiff quickly filed a police report and a DCPI spokesperson confirmed last June: ‘There is a criminal complaint on file for unlawful dissemination for a suspect with the name of Thomas Pentz, which is currently being investigated by NYPD detectives.’
Earlier this month, Rolling Stone reported that the three-time Grammy winner reached ‘a resolution in principle’ with Shelly Auguste in order to avoid a trial for her 2023 accusations of distributing nude photos of her without consent.
And back in 2021, a woman known as E.K. dropped a sexual-assault lawsuit against Diplo just 10 days after claiming he wouldn’t let her leave a Las Vegas hotel room in 2019 unless she performed oral sex on him.
‘Culture is quick to follow unsubstantiated claims. I’m a public figure and this comes with the territory and I understand that,’ the Mad Decent founder – who boasts 17.5M social media followers – wrote on Instagram in 2021.
‘I want to add also these previous claims have been dropped or abandoned and those facts go unreported. This is so frustrating and embarrassing. I am not this person and I won’t be extorted by anyone no matter how stinging the press can be. Even over the past two years, I’ve never been bothered by these rumors.
‘If anything, it made me strong and smarter. All of my friends and partners have never questioned me and that was what has been important to me – the people in my life know me for who I really am. I will continue to do everything I can to end this in the most respectful way but I will not give into lies and harassment.’
Diplo went on to sue the 27-year-old plaintiff, whom he called an ‘obsessed fan’ harassing him and his babymama, and he was awarded $1.2M in 2022 after an arbitrator found that her social media posts violated their mutual restraining order.

The Mississippi-born musician had a full-on legal war in 2020 against a prior Jane Doe who also alleged he raped her in a Las Vegas hotel room in 2019, gave her chlamydia, and recorded the sexual encounter without consent.
In response, Diplo filed a restraining order and claimed that she’d been harassing and stalking him for a long duration of time, and was posting nude photographs of him without his consent too.
