A woman who accused two luxury real estate agent brothers of rape continued to send the twins sexually explicit messages and invited herself to social events for over a year after the alleged attack, a shocking court document claims.

Real estate mogul twins Alon and Oren Alexander, both 36, were accused in a civil lawsuit of sexually assaulting Kate Whiteman, a New York woman who alleged last year that the brothers raped her at a castle-style mansion in the Hamptons in 2012. 

Her claim triggered a wave of subsequent allegations from dozens of other women, and the brothers were arrested in June 2024 and remain in custody in New York. They have maintained their innocence.

A new motion to dismiss Whiteman’s case filed this week in Suffolk County, obtained by the Daily Mail, shows that Whiteman allegedly sent a slew of explicit messages, erotic photos and social invites to the Alexander brothers for over a year and a half after the alleged rape.

In March 2024, Whiteman alleged that the real estate tycoon twins had sexually assaulted her over a decade prior at ‘Sir Ivan’s Castle,’ a mansion owned by recording artist and songwriter Ivan Wilzig.

She claimed in her lawsuit that she was ‘terrified’ of the brothers and was ‘so distraught after’ that ‘for months, she stayed in bed and very rarely left her home due to extreme depression, anxiety and fear for her own safety.’ 

But the motion to dismiss the lawsuit claims that just one month after the alleged rape, Whiteman wished Oren a happy birthday and asked if she could bring two female friends to his party. And, one year after the alleged assault, Whiteman asked the brothers to return to ‘Sir Ivan’s Castle.’

The Alexander brothers believe the messages undercut her allegations – an argument Whiteman’s attorneys adamantly dispute.

In a statement to the Daily Mail, the Alexanders’ attorney Jason Goldman said that Whiteman attempted to settle her claims against the high-flying real estate brokers for $35 million ‘in exchange for not ruining their lives.’

‘Despite having the means to silence her, they stood on integrity, refusing to pay a single penny, even when it would cost them their reputation, careers and freedom,’ he said.

On Tuesday evening, Whiteman’s attorneys filed a memorandum in opposition of the Alexanders’ motion to dismiss, in which they accuse the brothers of ‘cherry-picking’ the messages from Whiteman. 

They argue that the brothers’ motion contains a ‘version of events that is not only misleading but entirely contradicted by the record, the law, and the Alexanders’ life-long conduct.’

Whiteman alleged in her initial civil complaint that the rape unfolded on Memorial Day Weekend in 2012, and claimed that Alon grabbed her as she was leaving a nightclub and forced her into a waiting SUV with Oren.

In her complaint, she said she was driven to ‘Sir Ivan’s Castle’ where she was prevented from running away by a security guard, had her phone taken away and was forced to strip.

They then took her to a large bedroom where she was ‘sexually assaulted, abused, raped, pinned, groped, harassed, battered, and fondled by defendants Alon and Oren,’ according to her complaint.

But in the months and years after, the motion to dismiss claims it was Whiteman who continually reached out to the brothers with explicit images of herself and invites to social events.

The Alexanders’ motion to dismiss included messages sent 10 months after the alleged rape. In one, Whiteman sent Oren nude images of herself and said it would be ‘fun to get over’ her recent breakup if he came over to her apartment in Manhattan’s East Village, according to the filing.

In March 2013, a year after the alleged attack, Whiteman sent Oren a sexually explicit message on Facebook detailing how she was ‘touching herself,’ according to the court document.

And in May 2013, the filing claims she brought a female friend to Alon’s apartment and asked him to take a suggestive picture of them to send to Oren.

In another exchange included in the motion, Whiteman texted Oren a year after the alleged rape and asked how he liked Miami – then sent him a tirade against African Americans, using racial slurs.

The filing also claims that, on June 28, 2013, Whiteman invited the brothers to the Hamptons and suggested they ‘come have a party’ at her Hamptons rental and suggested they attend a party at ‘Sir Ivan’s Castle.’

The next day, per the motion, Whiteman told Oren that he and Alon ‘almost fulfilled my #1 fantasy’ – which court document alleges was a fantasy of the two brothers having sex with her at the same time. It is unclear what this is based upon. 

The same week, the court filing alleges that she texted Oren asking him to go for dinner in New York City, writing, ‘let me know where you make a reservation and let me know when you will pick me up.’

He responded: ‘Are you delusional?’

Whiteman, the motion claims, ‘continued her compulsive stalking’ of both brothers.

According to the filing, Whiteman sent Oren an ‘unsolicited and provocative photo of herself in a dress’, and also sent Alon ‘a flirtatious message offering him ‘kisses goodnight.” The court documents claim that she also sent a picture of herself lying in bed, and later invited him to go to a day spa with her.

In September 2013, the motion alleges that Whiteman sent Oren messages asking him to buy her a horse as a birthday gift, playfully threatening to tell Oren’s mother, Orly, if he failed to do so. He did not respond, per the filing.

According to the motion, ‘Whiteman has never met Oren’s mother, Orly. Rather, Whiteman only knows who Orly is from Whiteman’s continued stalking of Oren’s social media accounts.’ 

In December 2013, she again asked him to take her skiing to Aspen, which he did not respond to, court documents claim.

Prior to the alleged rape, Whiteman ‘aggressively pursued the Alexanders,’ per the court document, despite claiming in her complaint that she was not romantically interested in the brothers.

When he didn’t respond, she reached out three weeks later asking him to text her, according to the filing. 

The Alexanders further allege that in July 2022, Whiteman attempted to delete much of the correspondence between them by ‘unsending’ the messages on Facebook. 

‘Despite Ms Whiteman’s attempt to conceal and destroy this critical evidence, the Alexanders had previously taken screen shots to preserve them,’ the motion claims. 

It is alleged that Whiteman only came forward with her accusations after the brothers found success in the real estate world and that she demanded $35 million to settle her claims.

In a statement to the Daily Mail, Whiteman’s attorney Evan Torgan said that she ‘knew when she started her case, that they would do this to her.’

‘But her courage in the face of the onslaught brought forward what the FBI said were over 60 more women who had shared similar experiences,’ he continued.

‘But one thing we have learned over the recent years is that people who are sexually assaulted by trusted individuals have a complex reaction to the assault, and sometimes stay in contact with their abusers to try and retake some modicum of control over an unbearable memory.’

In their memorandum, Whiteman’s attorneys claim the exchanges are ‘stripped of trauma-informed context.’ They noted that the texts represent ‘informal and ambiguous communications’ that ‘even if authenticated – which they are not – cannot be considered documentary evidence for purposes of dismissal.’

‘The Alexanders desperately try to paint themselves as victims of a fabricated lawsuit yet fail to come to terms with the fact that the active federal indictment is for conduct strikingly similar to the conduct they are called to task for here,’ the filing reads. 

‘Multiple grand juries found cause to charge both of the Alexander brothers with serious offenses, including sexual misconduct, conspiracy and sex trafficking. 

‘Although these charges were brought independently of [Whiteman’s] civil suit, they substantiate the very pattern of abuse that she alleges.’

In response, the Alexanders’ attorney told the Daily Mail that ‘it speaks volumes that Whiteman’s only response to the receipts is to point to the number of other accusers brought against the Alexanders.’ Whiteman’s council, they note, also represents other alleged victims, including Rebecca Mandel, a woman who accused the brothers of sexual assault after Alon allegedly drugged her drink. They have denied this allegation.

The Alexanders’ lucrative real estate careers were upended after dozens women accused the brothers of sexual assault. Alon and Oren, along with their older brother Tal, were arrested in December and were charged with orchestrating a sex trafficking scheme for over a decade, according to the federal indictment.

The brothers have been accused of working together and with others to drug, sexually assault and rape dozens of women. Federal prosecutors say they have spoken to at  least 60 women who claim to be victims of at least one of the Alexander brothers.

The Alexanders have also been accused of using deception, fraud and coercion to lure victims to private locations for trips or events, where the brothers allegedly raped and sexually assaulted them, per the indictment. It is alleged that they used drugs to impair their victims, which prevented the victims from providing consent or fighting back.

In addition to federal charges, the Alexander brothers – who are currently awaiting their 2026 trial behind bars without bail at Brooklyn’s Metropolitan Detention Center – also face multiple sexual assault lawsuits across multiple states.

They have maintained their innocence, pleading not guilty to criminal charges and denying liability in the civil cases.

The Alexander brothers were once famed realtors with the renowned Douglas Elliman real estate firm and were often spotted rubbing shoulders with high-profile socialites. They made their name selling America’s most expensive property ever, a $238 million penthouse overlooking Central Park in 2019.

A friend of the Alexanders’, Ohad Fisherman, was charged last year with raping a woman with the brothers, but charges were dropped this month. It was found that he was on a boat at the time of the alleged rape.

With his name cleared, Fisherman said at a press conference: ‘This was a lie without a shred of proof… For nearly a year I’ve been dragged through the mud, arrested and labeled a monster based on a lie.’  

In their motion to dismiss Whiteman’s allegations, the Alexanders claim that they, too, have been maligned. 

Their attorney Goldman told Daily Mail that his motion on behalf of the brothers ‘speaks for itself.’ 

‘Ms. Whiteman’s false allegations are contradicted by her own messages, the same ones she tried to delete just prior to litigation,’ he said. 

‘In reality, she compulsively pursued the Alexanders for years after the alleged incident — behaving in a manner that even the most pliable victims’ expert would have trouble spinning.’
