Trump is stopping birth tourism operators from selling the American Dream

American citizenship is not a hotel amenity, yet a global industry markets access to it as part of an expensive travel package. Foreign operators recruit pregnant women, coach them to lie in visa applications and consular interviews, arrange their travel and housing, and then bank tens of thousands of dollars to arrange the birth of their child on American soil.

President Donald Trump’s administration is changing the enforcement strategy by treating birth tourism as a business designed to circumvent U.S. immigration laws. Secretary of State Marco Rubio recently announced a new visa policy targeting the people who knowingly sustain that business, including visa “fixers” who coach applicants to commit fraud and foreign medical providers who knowingly facilitate such travel or the fraudulent use of Medicaid.

Rather than stopping with individual travelers who misrepresent their plans, this policy follows the money to the operators who recruit them, coach them to lie and profit from the deception. These fixers can simply move from one paying customer to the next unless enforcement dismantles the business behind the fraud. President Trump understands that ending this birth-tourism black market requires consequences for the people selling access to American citizenship.

TRUMP ADMIN PUTS ALLEGED ‘BIRTH TOURISM’ SCHEME ON NOTICE AS EXPERT DELIVERS WARNING TO HOSPITALS

It is important to note that traveling while pregnant or seeking legitimate medical treatment with the appropriate visa and truthful disclosures is not illegal. However, immigration fraud occurs when someone materially misrepresents the purpose, duration or destination of a trip to obtain admission under false pretenses. The State Department explicitly prohibits using a visitor visa when the traveler’s primary purpose is to give birth in the United States so that a child obtains U.S. citizenship.

As an immigration attorney and an immigrant who came to America legally, I know firsthand that our immigration system relies on truthful representations in visa applications. A visitor visa permits temporary travel for a specific purpose. If we fail to enforce those limits, the visa process becomes a facade, and those who follow the rules are pushed behind those willing to manipulate them.

BIRTH TOURISM CRACKDOWN EXPANDS AS HOUSE CHAIRMAN RAISES CRIMINAL CONSPIRACY CASE

Commercial birth tourism is an organized, profit-driven industry that coaches applicants to deceive American officials. Federal prosecutions reveal just how extensive and brazen these operations have become. The Department of Justice secured jury convictions against two Southern California birth-tourism operators for conspiracy and international money laundering. Evidence showed that they coached customers to conceal pregnancies, misrepresent the length and purpose of their trips and enter through ports where they believed they would face less immigration scrutiny. Related indictments charged 19 people, including operators and clients, across three schemes. According to one indictment, an operation called You Win USA allegedly charged customers between $40,000 and $80,000, used 20 apartments and received

Three million dollars in international wire transfers from China over two years. Another indictment charged a former Irvine resident with operating Star Baby Care, which claimed in its advertising to have served 8,000 pregnant women.

US STATE DEPARTMENT HAS YANKED MORE THAN 175K VISAS UNDER TRUMP ADMINISTRATION SO FAR

Operators advertised employment, education and public-benefit advantages of American citizenship while instructing customers to lie to consular officers. Some clients were allegedly advised to wear loose clothing to conceal their pregnancies, claim they were visiting for only a few weeks and stay in maternity houses. The indictments also alleged that some customers failed to pay all medical costs associated with their hospital births.

To prevent the exploitation of U.S. citizenship, the Trump administration created a Birth Tourism and Prevention Task Force to identify visa abuse and dismantle fraudulent networks. Secretary Rubio’s new policy strengthens that effort by targeting the commercial infrastructure behind the applications. The task force has revoked more than 750 visas tied to suspected birth-tourism activity. The directive is clear: America will not issue visas to foreign operators who profit by coaching others to deceive American officials.

President Trump and Secretary Rubio understand that immigration enforcement must extend beyond the airport to the recruiters and businesses that make deception profitable. America welcomes lawful visitors, including those seeking legitimate medical care, but that welcome does not extend to fraudulent schemes built on deception.

Birth-tourism networks thrive when profits remain high and enforcement stops with the customer. By targeting the operators, the Trump administration is attaching consequences to those profits. The best way to deter fraudulent applications is to hold accountable the businesses that teach people to lie. American citizenship is a sacred national trust, not a cheap commodity sold to the highest bidder. President Trump is sending a clear message: The American Dream is not for sale.
